I stumbled across an interesting article this morning from the Associated Press: http://news.yahoo.com/s/ap/20090403/ap_on_re_af/af_malawi_madonna_adoption

This quote struck me:

"It is necessary that we look beyond the petitioner ... and consider the consequences of opening the doors too wide," the judge said. "By removing the very safeguard that is supposed to protect our children, the courts ... could actually facilitate trafficking of children by some unscrupulous individuals."

Seriously i dont understand these people and their so called legal system. Is the judges ruling based on a judicial precedent or is he trying to reinvent the will. "It is necessary that we look beyond the petitioner ... and consider the consequences of opening the doors too wide," the judge said. "By removing the very safeguard that is supposed to protect our children, the courts ... could actually facilitate trafficking of children by some unscrupulous individuals.

The law is the law, if she meets all the legal requirement what is the bickering about. Trafficking of children by unscrupulous individuals" oh please! Madonna established a foundation in Malawi, is she an unscrupulous individual? That judge needs to be debarred.

Madonna is trying to change the life of one child and break that circle of poverty for the girl family. The child's grandmother claims she is the child's guardian yet the child remains in a orphanage. This is a classic example of poverty mentality. Madonna should please come adopt me

Peace! Fatima

sincerely speaking i still don't understand certain polices and laws enacted in most of our countries especailly in Africa. They are usually unconventional and hinders progress, development and good faith.

I just think the Judge wanted to make headlines for i see no bearing with her claim for someone who has already done and is still carrying out more investments in their country. And if the Minister of child welfare is in support and has adhere to it, what is her objective to rule the contrary?.

I wonder and need to know howmany children she has adopted or assisted. Considering She is a judge with powers and i guess she should be affluent too.

Well, let's see how things turn out.

Regards

It is a sad thing to see what goes on in the 'corridors of (in)justice' in most probably all African nations and maybe others in the world. it is not a preserve of Malawi it is happening all over. Can these judges tell us what they have done to end trafficking in its real sense? Sincerely most of them would not even in lay man's terms define trafficking. There are conventions pertaining this issue and it is a matter of ratification and domestication by nations that would safeguard victims and prosecute perpetrators. Could the Malawian judge tell us whether they have done this?? If Madonna wanted to traffic why would she strain herself travelling all the way and being so much open about it while she could just relax and get a kid delivered to her without the knowledge of not even the parents? Of what use are laws that cause impediments to the well being of an individual considering that these same governments have no policies in place to protect abandoned children or those living in extreme poverty?

A kind of law that can not protect abandoned children and those living in extreme poverty but also preventing somebody that want to protect those children are not laws but a kind of rubbish. It will do the malawi government and other countries with these type of laws to re examine them seriously. African leaders knows what to do to stop child trafficking and they should stop these pretense of protecting children from trafficking when actually they are debbarring them from having better life
