Times of India 20 Feb 2012 – Hon. Bombay High Court Division Bench Hon. Justice V M Kanade & Hon. Justice M L Tahaliyani “In a case under the Prevention of Corruption Act, the Inaction or Omission on the part of the Public Servant of not passing any order on any application or passing an adverse order since bribe is not given would constitute the loss or injury & therefore, even such a complaint would fall within the category of a victim” … The Hon. Judges said injury in cases filed under anti graft law “is caused by the public servant in not discharging his duty”.

• Vashi Police is Not Registering my FIR Since Last 1 Year 2 Months - because PRIMA FACIE when I have Severed my Relation with Accused with 2 LEGAL NOTICES in 2007 hence they have No Legal Right to even contact me but from August 2010 they are Forcibly coming to my House, Threatening me, Standing outside my Building & Asking for my Bank A/c No. & Signature & as GROUNDS FOR FIR, I have informed Vashi Police that Accused have Looted & Cheated me before also resulting in my family’s Financial Destruction leading to Deaths of my Husband & son & Suicide by my Handicapped daughter & the Fact that so many old Grandmothers have been MURDERD by their Grandsons for Money even though they had good relation with their grandsons- so I have More Fear of Life, Looting & Harm from my Accused Grandsons
• Vashi Police Deliberately under it’s Planned Conspiracy with Accused Tells me to go to the Court to PROTECT ACCUSED- saying this is a Civil Matter of Family Financial Dispute EVEN After I have myself written in my Police Complaint that for the Financial Part The Court will Decide But Vashi Police should Charge the Accused for Threatening me & Forcibly coming to my House & Asking for my Bank A/c No. & Sign to Loot me & Harm a 77 year Senior Citizen Widow EVEN After I have Severed my Relation with them by giving 2 Legal Notices !!!

• Vashi Police is Not Registering my FIR, EVEN After Repeat Offences by Accused - Accused are Threatening me AGAIN & AGAIN – from August –December 2010, AGAIN in March 2011 & AGAIN in June 2011
• Vashi Police Not Taken Statement of Main Accused Nor Called him to Police Station – Yet Even after 1 Year 2 Months !!! DCP Purushotam Karad LYING in his Replies that Main Accused is in Dubai- when we have informed Police that he has been coming to India !!!+ Vashi Sr. PI Laxman Kale making False Submissions to Hon. JMFC Vashi Court that he is in Dubai. We have informed them that Main Accused has come to India + Accused’s own Mother Sumita Karani has given a Statement to Vashi Police that yes his son Main Accused Manoj Karani was in India in August 2011 !!! Why Vashi Police did not call him to Vashi Police Station ???!!! Why Vashi Police has not taken any Action against Sumita Karani for not Informing Vashi Police / Sending him to Vashi Police Station, as she was asked by Vashi Police to do when her son comes to India ???!!! – THIS IS CLEAR PROTECTION OF MAIN ACCUSED BY VASHI POLICE !!!
• Vashi Police not Registering my 2nd Complaint – Repeat Offence by Accused Sanjeev Karani & Wife Rakhi Karani in Contact on Mobile with Criminal Hiten Sampat who Looted me in March 2011 ( Airtel Mobile Records given to Vashi Police as Documentary Evidence)
• Vashi Police not Registering my 3RD Complaint – Repeat Offence by Accused Urmi Manoj Karani Threatening me on June 19, 2011 by Phone

(I) MSCW Officials Deliberately Not Discharging Their Duty + Not Following Process of Law – TO PROTECT ACCUSED:
+ NOW MSCW Secretary Mrs. K V Pandit Files a False & Frivolous Complaint against my son at Kherwadi Polce Station TO HARASS & TORTURE ME, the Complainant & Victim !!!:

• MSCW does Not even Start my Case in February 2011 after NCW Transferred my Case to MSCW, But Asks me to go to the Court !!!
• MSCW was FORCED to Start my Case in June 2011 only After I approached Union Minister for Women & Child Dev. (MWCD), New Delhi Smt. Krishna Tirath ji. MWCD Minister wrote to NCW & NCW Passed an Order dt. 09 May 2011 to MSCW & NM Police for immediate action against Accused + GRANT OF RELIEF to me
• But MSCW has Not Taken any Action against Accused NOR Got me any GRANT OF RELIEF – and like Vashi Police they have also Not Called Main Accused YET EVEN AFTER 1 YEAR !!!
• + MSCW also Gives False / No Replies under RTI + No Hearing for my RTI 1st Appeal + No Reply Till Date !!!
• + + ON THE CONTRARY MSCW Secretary Files a False & Frivolous Police Complaint against my son – TO HARASS US !!!
• All we did was requested Mrs. K V Pandit to let my son Speak on my Behalf in the RTI 1st Hearing on 30 December 2011 as I am Old & not well & not familiar with NCW/MSCW Case / RTI laws & do not understand Marathi & English so my son will speak on my behalf as he has been doing everywhere-Hon. CM’s, DyCM’s, HM’s & DGP’s office and my son stood up to answer her. But Mrs. K V Pandit SHOCKINGLY said this is your RTI your son can not speak & she Rang the bell & called the police officer stationed at MSCW office to throw my son out !!! I pleaded with her to let my son speak on the reasons mentioned above but SHOCKINGLY she called the police & asked him to throw me also out !!! So I called my son & he came in & quietly took my hand & we went out & we went home.

Which NCW /MSCW Law says my son can not speak on my behalf in my case ??? On the contrary NCW/MSCW website clearly states anyone can File a Complaint on behalf of Poor & helpless Victim Woman & Help & Represent her !!!
Which RTI Law says my son can not speak on my behalf in my case with me being old, unwell & poorly literate, harassed, tortured, looted, cheated & again Threatened by Accused ???!!!
• It was Pre-Planned by Mrs. K V Pandit NOT TO GIVE US A FAIR HEARING, because SHE WAS AWARE from the No. of Complaints we have made against MSCW officials to Hon. CJI Supreme Court, CJ Bombay High Court, President, PM, HM, NCW (National Commission for Women), Ministry of Women & Child, New Delhi & Hon. Maharshtra CM, DyCM, HM, M/O W&C that MSCW first did not even Start our Case up to June 2011 & then on the Orders from Delhi NCW & M/O W&C was FORCED to start my Case BUT MADE A MOCKERY OF IT so I did RTI to which MSCW PUPOSELY gave me False / No Replies BECAUSE THEY DID NOT HAVE THE CORRECT INFORMATION AS THEY HAD NOT CONDUTED MY CASE FAIRLY & PROPERLY FOR THE LAST 1 YEAR-AS MSCW WAS CLEARLY PROTECTING RICH & POWERFUL ACCUSED . So I sent my RTI 1st Appeal. My attached PRIMA FACIE Documentary Evidences, especially NO HEARING & Submission letters dt. 06 January 2012 & 30 December 2011, clearly explain this TRUTH in detail.

• BIGGEST PROOF IS TILL TODAY MRS. K V PANDIT HAS NOT GIVEN ME A REPLY TO MY 1ST APPEAL dt. 24 -11-2011- Because she does NOT have a Correct / Proper Reply to GIVE as she knows that MSCW has made a Mockery of my Case, THAT IS WHY SHE FILES A FALSE & FRIVOLOUS POLICE COMPLAINT AGAINST MY SON ON FILMSY GROUNDS TO AVOID GIVING ME A REPLY !!!
• + ALSO NO REPLY FROM MSCW TO MY RTI APPLICATION TRANSFERRED BY SMT. SONIA GANDHIJI’S PIO FROM HER NAC OFFICE IN NOVEMBER 2011.

(II) Why NCW & MSCW is NOT Registering my Case of DOMESTIC VIOLENCE against my Accused Grandsons ???!!!

• My 3 Accused Grandsons Manoj, Sanjeev & Jeetendra Karani have Stayed with me at my house for 9 years from 1977-86 & I was FORCED to pay for their Lodging, Boarding & Schooling Expenses as their Parents Forcibly Dumped them on us. THEIR PARENTS NOR THEM HAVE PAID ME A SINGLE RUPEE TILL DATE. My Family was Financialy Destroyed because of this-Leading to the untimely Deaths of my Husband & 34 year old young Son & Suicide by my other unmarried Handicapped Daughter as we could not undertake their Timely Hospitalisation.
• ON TOP EVEN AFTER SEVERING MY RELATION LEGALLY WITH THEM IN 2007 DUE TO PAST ATROCITIES, from August 2010 AGAIN, they are Thraetening me, Forcibly Coming to my House, asking for my Bank A/c No. & Signature to Loot, Cheat & Harm me AGAIN

• MSHRC (Maharashtra State Human Rights Commission) sent 3 Repeated Notices to NM CP each time giving him 4 weeks time to submit its Report to MSHRC failing which :” the Commission may proceed to take such action, as it deems fit & proper”
• NM CP Ahmad Javed Does Not send his Report Till December 2011 BUT SHOCKINGLY MSHRC TAKES NO ACTION !!!
• MSHRC FINALLY kept Final Hearing on 22 December 2010 - After I raised Objection & Summons were sent to (1) NM CP Ahmad Javed (2) Vashi PSI Shri Raosaheb Sardesai (3) Me to appear in Person before the Commission on 22 Dec ’10 at 11.00 am
• Respondents (1) NM CP Ahmad Javed (2) Vashi PSI Shri Raosaheb Sardesai did not come hence Your Hon Justice waited upto 12.30 & then passed the FINAL ORDER: as mentioned in the Summons in case Respondents failed to come & dictated as follows: “ As Mohini Kamwani has severed her relation legally with Accused then Accused Jeetendra, Manoj & Sanjeev Karani have no Legal Right to Forcibly go to her house, stand outside her building, Threaten her & ask for her Bank A/C No. & Signature. Vashi police take action against Accused as Mohini Kamwani is a Senior Citizen”
• I waited upto 2.00pm & asked for my Copy of the Final Order, but I was told I will get on 02 January 2012 as the Hon. Justice is going on leave. But when I collected my copy, I was Shocked – The Hon. MSHRC Chairperson Justice Shri Vyasji had CHANGED THE ORDER COMPLETELY !!! As Vashi Police Under Its PLANNED CONSPIRACY Sent 2 Junior Officers (Not The Respondents NM CP & Vashi PSI In Person), AFTER PASSING OF THE FINAL ORDER BY HON. JUSTICE , Submitting False & Misleading Reports Which They Have Been Doing Since 1 Year To Protect Accused, & the Hon. Justice CHANGED THE FINAL ORDER STATING THIS IS A CIVIL MATTER & I AM CLAIMING MAINTENANCE THAT IS WHY VASHI POLICE HAS NOT REGISTERED MY FIR !!! The Order, Further Confusingly States That FIR HAS BEEN REGISTERED & THE CASE IS CLOSED !!!???
• Other SHOCKING PRIMA FACIE Documentary Evidences of Times of India Articles Attached – on MSHRC Human Rights Commission Chief “inJustice” K R Vyas, which Clearly State that under the “able?” Chairmanship of “inJustice” K R Vyas from 2007-2012, “not a single one of the 506 custodial death case was disposed off by the commission” !!! The matter was brought to light by judge-turned activist V P Patil, who said the purpose of setting up the commission stood defeated. “All custodial death cases were referred to a member who was a retired IPS officer. Since either jail or police officers are involved in custodial death cases, how can one expect justice from such a member? I feel such a member is bound to protect his colleagues.” + Hon. SC Justices Aftab Alam & Ranjana P Desai intervened to STOP “inJustice” K R Vyas from being appointed as Chief of the Committee monitoring Special Task Force’s Probe into several Encounter Killings between 2002-2006 in Gujarat, without Consulting the Hon. Supreme Court & finally Hon. SC appointed a Hon. SC Judge !!!
